Tower Hill Continues to Avoid Paying Marion County Sinkhole Victims

The company is appealing a decision that required them to pay for a policyholders’ sinkhole damage. In Glen and Kimberly Traving v. Tower Hill, Fifth Circuit Court Judge Frances King ruled that the insurer was responsible for subsurface repair costs. However, rather than a check for repairs, the Trabings got a notice that the decision in their favor was being appealed.

This appeal is not Tower Hill’s first attempt to avoid covering the Trabings’ sinkhole damage. The insurer spent two years litigating the initial claim, rather than resolving it in a fair way. When they were unsuccessful in court, Tower Hill tried to force the policyholders to begin making repairs before receiving payment. Again, they were defeated in court and ordered to pay the claim.
